1. Acceptance of Terms

  • In the event a product is listed at an incorrect price or with incorrect information due to a typographical, pricing, or system error, we reserve the right to refuse or cancel any order placed for that product, whether or not the order has been confirmed, and to refund any amount already charged.
  • We reserve the right to limit quantities, discontinue products, and refuse service to any person or order, at our discretion.

5. Orders & Payment

  • Placing an order is an offer to purchase; an order is not accepted until we send you a shipping confirmation, or, if earlier, until payment is captured for an in-stock item.
  • Payment is processed securely through Shopify Payments and/or other payment methods made available at checkout (which may include major credit/debit cards, PayPal, and buy-now-pay-later providers). By submitting payment information, you represent that you are authorized to use the payment method provided.
  • Applicable sales tax, VAT, or other transaction taxes will be calculated and added at checkout where required by law.
  • We reserve the right to cancel or refuse any order we suspect involves fraud, unauthorized or illegal activity, or a violation of these Terms.

6. Shipping & Delivery

  • We ship worldwide. Shipping methods, carriers, and estimated delivery times will be presented at checkout and are estimates only; we do not guarantee specific delivery dates.
  • Risk of loss and title for products purchased pass to you upon our delivery of the item to the shipping carrier.
  • For international orders, you are responsible for any customs duties, import taxes, brokerage fees, and other charges levied by the destination country. These charges are not included in the item price or shipping cost and are collected by the carrier or customs authority. Octane Culture LLC is not responsible for delays caused by customs processing.
  • You are responsible for providing an accurate shipping address. We are not liable for orders delayed, misdelivered, or lost due to an incorrect address provided at checkout.

7. Returns, Exchanges & Refunds

  • We accept returns and exchanges within 14 days of the delivery date, provided the item is unworn, unwashed, undamaged, and returned with all original tags and packaging intact.
  • The following items are not eligible for return, except in the case of a manufacturing defect: final sale/clearance items, and any other items marked as final sale at the time of purchase.

  • Approved refunds will be issued to the original payment method within a commercially reasonable time after we receive and inspect the returned item. Original shipping charges are non-refundable, except where the return is due to our error or a defective item.
  • International customers are responsible for any customs duties or taxes paid on a returned order; these are not refunded by Octane Culture LLC.

16. Governing Law & Dispute Resolution

Governing Law.

These Terms and any dispute arising from them will be governed by the laws of the State of California, without regard to its conflict-of-law principles, and without regard to the United Nations Convention on Contracts for the International Sale of Goods.

Informal Resolution.

Arbitration Agreement.

If a dispute is not resolved informally, you and Octane Culture LLC agree that it will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small claims court if it qualifies.
